Trump issued an executive order on January 20, 2025, which defined gender for males and females. This is another executive order that didn't, on its face, affect immigration, but does have implications for immigration and nationality law.
What does it mean for you?
This week, the U.S. State Department has instructed staff to halt the issuance of passports and other official documents featuring “X” sex markers.
📜 The directive states:
👉 “The policy of the United States is that an individual’s sex is not changeable.”
👉 “Sex, and not gender, shall be used in official documents.”
This change will impact both pending and future applications. Individuals who have already applied for passports with an “X” marker or planned to apply using this option may need to adjust their applications accordingly.
This will not affect anyone who has a current passport with an "X" marker.
